SCENE ONE:
In mid January 2012, I came home one evening and found a dog in my back yard. Upon seeing me, the dog immediately headed up my hill. I noticed he was limping, holding his right rear leg up as he climbed the hill. He sat at the top of the hill and watched me until I went into the house. Later that evening I went out and did not see the dog and thought he had left. The side gate to the backyard to my property was open all the time. Generally when home I would leave the garage open. Access from the front yard to the back yard was never inhibited.
Over the next few days I noticed the dog was occasionally in the back yard or on the hill. At first I thought he might be leaving during the day and then returning in the evening, as during the week end I had not seen him at all. Monday evening he was back on the hill. If I took notice of him, he would disappear up the hill. I placed sliced hotdogs on a plate at the base of the hill. The hotdogs remained at ten o’clock in the evening, but by morning the hotdogs were gone. Two days later, the same timeline for the disappearing hotdogs was unchanged. By the weekend I decided to sit out-back and listen to some music. Additionally, I placed the hotdogs closer to the house. The dog came off the hill near nine o’clock in the evening and slowly went to the plate and ate. I did not act at all interested, but watched out of the corner of my eye. After eating he immediately went back up the hill.
On Sunday, near noon I climbed the hill and found the dog snuggled into a hole under a bush at the top of the hill. I stayed my distance, but told him I wondered where he was hiding and he should come down at night and sleep inside the house as it was much warmer (evening temperatures were dropping to near 32 degrees). A side note, prior to the appearance of the dog, when I was home, I would leave my front door open a foot or so to allow fresh air to circulate in the evening. I continued to leave two or three sliced hotdogs on a plate in the back yard nightly.
On Tuesday evening, I awoke around eleven o’clock to a pitter-patter in the hallway. I looked out and saw a low shadow look into my room, turn and enter my daughter’s (now unoccupied) room next door and lay down on the floor at the foot of the bed. I ignored my guest and went to sleep. I awoke to the alarm at three-thirty the next morning and witnessed my guest zooming out of the bedroom next door, skidding around the corner and heading for the front door like Fred Flintstone accelerating his stone vehicle heading to work.
The next evening, I placed a folded up blanket on the floor at the foot of my daughter’s bed. Later that night, a similar progression of the events of the previous evening was repeated. When the alarm went off, I switched the light on and saw the dog jump up off the blanket and run to the front door and outside. During this time, I continued to leave the garage door, the garage side door and the side gate open all night. The dog could exit my property whenever he desired. Apparently, he did not want to leave.
